Only 4 (four) out of a total of 122 verdicts in the East Java Religious High Court in Surabaya regarding disputes over joint property (gono-gini) for working women who are outside the normative provisions of the Compilation of Islamic Law (namely half of the total property for women). In these four cases, the judges decided that the working woman’s share should be more than half or half of the disputed property. The judges’ decisions were based on various arguments in line with the maqashid al-shari’ah (Adiyono, “Justice in the Distribution of Joint Property for Working Women by the Verdicts of the Surabaya Religious High Court”, PhD dissertation in Islamic Studies, 2023).
